1. About these Terms

These Terms and Conditions (“Terms”) govern your access to and use of my apps and related services (collectively, the “Services”). By downloading, accessing, or using any of my Services, you agree to be bound by these Terms and my Privacy Policy. If you do not agree, do not use the Services.

These Terms are intended to be reusable across multiple apps I publish. Where these Terms refer to an “App”, it means any mobile, desktop, or web application I make available under my developer account(s) and/or brand(s).

Definitions

  • “I” / “me” / “my” means the publisher of the App(s) identified in Section 15 (Contact).
  • “App” means any application I publish that links to these Terms.
  • “Services” means the App and any related features, content, websites, or support services I provide.
  • “User Content” means any content you create, upload, store, or share through the Services.

2. Eligibility and Age Requirement

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. If you are under 18, you represent that you have permission from your parent or guardian.

3. Accounts

Some features may require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

I may suspend or terminate access to the Services if I reasonably believe:

  • you have violated these Terms,
  • your use poses a security risk, or
  • I am required to do so by law.

4. Subscriptions and Purchases

Some Apps may offer paid features via auto-renewable subscriptions, in-app purchases, or free trials.

4.1 App Store processing

Purchases and subscriptions are processed by the Apple App Store, Google Play Store, or other authorised marketplaces (each an “App Store”) and are subject to the App Store’s terms, including payment, tax, and refund policies.

4.2 Pricing and billing

The price and billing frequency (for example, monthly or yearly) are shown in the purchase flow before you confirm payment. Where applicable:

  • Payment will be charged to your App Store account at confirmation of purchase (or after any free trial or introductory period ends).
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Your account may be charged for renewal within 24 hours prior to the end of the current period.

4.3 Trials and introductory offers

If an App offers a free trial or introductory offer, it converts to a paid subscription unless you cancel at least 24 hours before the trial/offer ends.

4.4 Managing and cancelling

You can manage and cancel subscriptions in your App Store account settings. Deleting an App does not automatically cancel a subscription.

4.5 Restore purchases

Where supported, you can restore purchases using the “Restore” option in the App.

5. User-Generated Content

You may create, upload, store, or share User Content through the Services.

You retain ownership of your User Content. However, you grant me a worldwide, non-exclusive, royalty-free licence to use, host, store, reproduce, and display your User Content solely as necessary to operate, maintain, secure, and improve the Services.

You are solely responsible for your User Content and must ensure it does not:

  • infringe intellectual property, privacy, or other rights,
  • contain illegal, harmful, or offensive material,
  • violate these Terms or applicable law.

I may remove or restrict access to User Content where I reasonably believe it breaches these Terms or is required by law.

6. Prohibited Conduct

You agree not to:

  • use the Services for unlawful or unauthorised purposes,
  • reverse engineer, decompile, or disassemble any part of the Services except where permitted by law,
  • interfere with or disrupt the Services, servers, or networks,
  • upload malware, spam, or deceptive content,
  • harvest or collect personal data of others without consent.

7. Device Permissions

Depending on the App and features you use, the Services may request access to device features such as the camera, photo library, contacts, notifications, location, or other device capabilities.

You can change or revoke permissions at any time in your device settings. Denying permissions may limit certain functionality.

8. Intellectual Property

Except for User Content, the Services (including software, design, trademarks, and content) are owned by me or my licensors and are protected by applicable laws.

You may not copy, modify, distribute, sell, or lease any part of the Services unless permitted by law or with my written permission.

The Services may integrate with or link to third-party services. I do not control third-party services and am not responsible for their content, security, or practices. Your use of third-party services is at your own risk and may be governed by their terms.

10. Disclaimers

  • The Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.
  • I do not guarantee that the Services will be uninterrupted, error-free, or secure.
  • Some features may rely on third-party services or device capabilities and may not be available at all times.

11. Limitation of Liability

To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

12. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold me harmless from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer resident in the EEA or other jurisdictions that provide mandatory consumer protections, nothing in these Terms affects your statutory rights, and you may have the benefit of mandatory provisions of the law of your country of residence.

Subject to the above, the courts of England and Wales shall have exclusive jurisdiction over disputes arising out of or relating to these Terms.

14. Changes to the Terms

I may modify these Terms from time to time. If changes are material, I will take reasonable steps to notify you (for example, via the App or by updating the “Last updated” date). Your continued use of the Services after changes become effective constitutes acceptance.
